KEDAH CHINESE CHAMBER OF COMMERCE
CHARITY, SCHOLARSHIP AND EDUCATION AID FUND COMMITTEE RULES AND REGULATION

|
1. NAME
The Committee shall be called “THE KEDAH CHINESE CHAMBER OF COMMERCE CHARITY, SCHOLARSHIP AND AID FUND COMMITTEE”.
2. OBJECTIVE
a. To help youths from poor families irrespective of race who are of good behavior and excel in education to further their studies so as to make them useful citizens of the country.
b. To provide relief aid in times of natural disasters such as floods, fire etc. affecting the poor section of any community.
3. MANAGEMENT
a. The Committee members of the Kedah Chinese Chamber of Commerce shall be the committee members of the committee.
b. A Chairman, Vice Chairman, Treasure, Secretary and Auditor shall be selected from the Committee members of the Kedah Chinese Chamber of Commerce and appointed to the committee.
4. RESPONSIBILITIES
a. To plan, organize and take charge of the Charity Fund.
b. To form an investigating and selecting sub-committee.
c. To prepare application forms and to set regulations pertaining to the application of scholarship, education aid and charity fund.
d. To engage a registered accountant to audit the account.
e. The auditor shall audit all accounts and use of fund and submit reports to the committee.
5. DUTIES AND POWERS
a. The Chairman shall be responsible for the implementation of all solutions passed by the committee, sign Scholarship Agreements and to be responsible for the distribution of scholarship, education aid and relief fund.
b. The Vice Chairman shall assist the Chairman in his duties and act on behalf of the Chairman in his absence.
c. The investigating sub-committee shall be responsible for the investigation of the conduct and education of the scholarship or education aid applicants as well as the condition or charity fund applicants.
d. The Treasurer shall take charge of all the scholarship, education air and charity fund and to collect and disburse all money for the committee. All receipts of money shall be deposited into the committee’s appointed bank account.
e. The Secretary shall assist the Chairman in his duties, in charge of all records of applicants i.e. applicant forms, certificates, personal curriculum and to submit reports when necessary.
6. MEETING
Committee meetings shall be held at least twice a year and the Chairman shall hold an impromptu meeting if he considers necessary. An impromptu meeting must be attended by a minimum of five (5) committee members to hold a forum.
7. PROHIBITION
A committee member, who has any relationship with an applicant shall not be allowed to investigate or select the applicant.
8. RECORD
The committee shall keep a record of all meetings and shall submit a report to the Annual General Meeting of the Kedah Chinese Chamber of Commerce.
9. SOURCE OF FUND
To collect donation from public benefit enthusiast, societies and members of the Kedah Chinese Chamber of Commerce to a target of RM1,000,000.00.
10. USE OF FUND
a. The amount of money distributed to the members of the scholarship, education aid and charity fund depends solely on the amount of the fund collected.
b. The name of any public benefit enthusiast body or member, of the Kedah Chinese Chamber of Commerce who wish to sponsor for one or more scholarship or education aid shall be made in the name of the said scholarship or education aid provided the contribution is a minimum of RM20,000.00 for each scholarship and RM10,000.00 for each education aid.
11. MAINTAINING OF FUND
All funds received shall be paid into the committee’s appointed bank account or licensed finance company in the name of the committee. All withdrawals shall be signed by the Treasurer together with any two (2) persons, namely the Chairman, Vice Chairman and Secretary.
12. APPLICANT PROCEDURE
a. Application for the charity fund shall comply with the following conditions :-
i) fire, flood, calamities and refugees;
ii) aged persons without any dependants.
b. Applicants irrespect of race should be certified and recommend by Justice of the Peace, Heads of Societies or Chairman of the Board of Governors of any school to be eligible to apply for scholarship and education aid.
c. Applicants of scholarship and education aid will be required to fill in four (4) copies of application forms together with a photostat copy of certificates and accompanied by two (2) passport size photographs. Application forms should be submitted during the period required by the committee for selection. Any incomplete application forms will not be considered.
d. Application for scholarship and education aid shall comply with the following conditions :-
i) come from poor families with good conduct, good health and has proved with good results in education.
ii) must pass a civil examination from a government recognized university or institute.
iii) applicants must be Malaysian citizens and families of applicants must be residents of the state of Kedah.
iv) any applicant who has been offered scholarship or education aid from other bodies will not be entertained.
e. Applicants granted for scholarship, education aid shall be notified with a period of three (3) weeks and will be required to submit their personal curriculum for inspection. Should any applicant fail to submit their curriculum within the said period, the application will be regarded as void and the scholarship or education aid shall be granted to the other applicants accordingly.
f. The scholarship or education aid holders shall also submit their annual reports on progress of their studies. The committee has the right to terminate the said scholarship or education aid if a holder’s conduct and progress are found to be unsatisfactory.
i) Scholarship or education aid holders who stop their studies during the course of their scholarship or education aid shall have their scholarship education aid forfeited.
ii) A scholarship or education aid holder shall resubmit application forms every year and the scholarship or education aid shall be further granted if the applicant is found to comply with the requirements.
iii) The maximum period of a scholarship or education aid shall be four (4) years. The committee shall consider on special cases.
g. Scholarship for one year shall be RM2,000.00 and education aid shall be RM1,000.00.
h. Scholarship or education aid holders shall produce a witness during the execution of the said agreement.。
i. A guarantor agreeable by the committee is required for every scholarship or education aid holder. In case of any breach of trust or defraud the guarantor shall be held responsible for compensation.
13. “Audit : - In addition, and External Auditor who is a qualified public auditor, shall be appointed to audit the accounts of the Director General of Inland Revenue Malaysia.”
14. “Dissolution of the Fund :- In the event of the dissolution of the Fund the surplus monies shall be donated to the Government (Federal or State) or other Funds or similar character approved by the Director General of Inland Revenue Malaysia or handed over to the Public Trustee to be held in trust for purposes of augmenting later with the consent of the Director General of Inland Revenue Malaysia other Funds of similar character.” |
